Practice

Henri Alvarez articled at the firm now known as Fasken Martineau DuMoulin LLP and was admitted to the British Columbia Bar in 1981. After spending two years studying International Law and arbitration at the Graduate Institute of International Studies in Geneva, Switzerland, he rejoined the firm and practices in the Litigation and Dispute Resolution Department.

Henri has expertise in the field of international commercial arbitration and dispute resolution, in which he has taught a course at the Faculty of Law at the University of British Columbia since 1985. He is an experienced arbitrator and has acted as an arbitrator and as counsel in international and domestic commercial arbitrations involving investments, trade, franchising,

licensing, distributorship, construction, forestry and general commercial disputes. Henri also appears as counsel in mediations and has acted as a mediator in both international and domestic matters on a number of occasions. He is a Chapter 19 Panelist under the North American Free Trade Agreement. Henri is the leader of the firm’s Latin American and International Dispute Resolution Practice Groups.

  • Counsel in international commercial arbitrations dealing with distributorship and construction, long-term supply and commercial agreements and disputes.
  • Chairman of a three person arbitral tribunal in an international sales dispute.
  • One of three jointly-selected arbitrators in large international licensing and intellectual property disputes.
  • Chair of arbitral panels in various domain name disputes
  • Mediator in an international construction dispute involving a large hydro electric project in Latin America.
  • Various appointments, including chairmanship of tribunals, have been conducted entirely in Spanish or French.
  • Counsel to the British Columbia International Commercial Arbitration Centre before the B.C. Supreme Court in applications relating to its jurisdiction and rules.
  • Counsel in applications to recognize and enforce international and foreign arbitral awards in Canadian Courts.
  • Member of five person bi-national panels under Chapter 19 of the NAFTA dealing with disputes regarding the alleged dumping of products and material injury determinations.
