Mr. Bienvenu is a partner of Ogilvy
Renault, practising in their Montréal office. He has been with Ogilvy
Renault's litigation group since 1983 and is a member of the firm's management
committee. He is a graduate of the Faculty of Law of the Université de
Montréal and of the London School of Economics and Political Science. He
practises commercial arbitration and litigation, competition law and
constitutional law.
Mr. Bienvenu has acted as counsel
in numerous domestic and international commercial arbitration cases, both ad
hoc and institutional, in relation to disputes in the fields of
construction, aeronautics, international distribution and joint ventures, and
major telecommunications. He has also served as administrative secretary in
several major international commercial arbitration cases conducted under the
aegis of the ICC. Mr. Bienvenu is a Fellow of the Chartered Institute of
Arbitrators in London and the head of Ogilvy Renault's Alternative Dispute
Resolution Methods Team.
In addition to appearing before
various administrative and arbitral tribunals, Mr. Bienvenu has pleaded before
the courts of Québec, the Federal Court of Canada and the Supreme Court
of Canada. He has been involved in numerous challenges to the constitutional
validity of provincial and federal legislation. In 1996, Mr. Bienvenu was
retained by the Government of Canada to represent the Attorney General of
Canada in litigation concerning the legality, under both Canadian
constitutional law and public international law, of the secession of the
Province of Québec from Canada. He was co-counsel for the Attorney
General of Canada in the Government of Canada's Reference to the Supreme Court
of Canada concerning certain questions relating to the secession of
Québec.
Mr. Bienvenu is a member of Council
of the Canadian Bar Association, a member of its International Development
Committee, and a past member of the Executive Committee of the CBA's
Québec Division. He is former President of the Constitutional Law and
Civil Liberties Section of the Canadian Bar Association, Québec
Division, and former Chair of the Enforcement Practices and Procedures
Committee of the National Competition Law Section of the latter association.
Mr. Bienvenu is also a member of the International Institute for the
Unification of Private Law (UNIDROIT). He has held a teaching position at the
Québec Bar Admission Course and is regularly called upon as a guest
speaker on various topics of interest in his areas of practice.
