Professional Career
Mr. McKelvey was admitted to the Bar
of New Brunswick in 1949. He has practiced law in Saint John, New Brunswick,
since 1949; since 1955 as senior partner of McKelvey Macaulay Machum and as a
partner of Stewart McKelvey Stirling Scales, an Atlantic Canada law firm, in
1990; becoming counsel to that firm in 1991. Present practice consists of
general civil litigation and arbitration, primarily commercial, construction,
tax and shipping disputes.
He was appointed Queens Counsel in 1960.

Specific Arbitration Experience
As Counsel
Represented the contractor in claims relating to a
major hydro-electric power development dispute in 1969-1974.
Represented the shipbuilder in a major dispute
relating to the construction of a sea-going ferry in 1983-1985.
Represented the contractor in a dispute relating to
the installation of services in the Yukon Territory of Canada.
Represented management in many labour
arbitrations.
Extensive experience in litigation of construction,
breach of contract and other commercial disputes is also related to
arbitration.
As Arbitrator
Chairman of an ICC arbitration board in an $80
million dispute between a Saudi Arabian company and a United States company
concerning the manufacture and sale of mobile homes to Saudi Arabia, 1984-88.
Held in Los Angeles, CA.
Chairman of an ICC arbitration board in a dispute
between a South Korean company and a United States company concerning a license
agreement, 1991-93. Held in Dallas, TX.
Sole arbitrator in an ICC arbitration between a
United States company and an Italian company involving a claim for breach of a
representation agreement. Held in New York, NY.
Appointed sole arbitrator in an ICC arbitration
settled after drafting Terms of Reference.
Presently Chairman of an ICC arbitration board in a
dispute between a United Kingdom company and a Belgian company concerning an
agreement for the manufacture of knit products. To be held in New York, NY.
Chairman of a dispute panel under Chapter 19 of the
North American Free Trade Agreement hearing a reference from the Canadian
International Trade Tribunal on injury caused by dumping held in Ottawa,
Canada, 1995.
Sole arbitrator in a dispute in the Northwest
Territories of Canada relating to housing construction in 1983.
Sole arbitrator in a dispute relating to the
construction of services in the Province of Newfoundland.
Many labour arbitrations as the nominee of the
employer.
