Practice
Jim Myers has had over 25 years of
experience in domestic and international arbitration, mediation and dispute
resolution and international construction and procurement law. His dispute
resolution practice has primarily been focused on construction industry
disputes throughout the world, which includes public and private contracts,
infrastructure development through privately financed public projects,
representation of public and private owners, general contractors,
subcontractors, architects, engineers, industry associations and suppliers and
managers in projects utilizing traditional and new delivery methods, and
consultation on construction finance, legislation, bidding, and contract
formation, performance, termination and completion. Substantial experience with
all aspects of alternate dispute resolution and the preparation, evaluation,
negotiation, and litigation and arbitration of claims.
Dispute Resolution Experience
Arbitrated numerous proceedings,
primarily construction arbitrations in the United States under the auspices of
the AAA and various court appointments. Regularly serve abroad as arbitrator in
proceedings administered by the International Chamber of Commerce (ICC) in
Paris. AAA Large Complex Case Program (LCCP) national panelist. Sole arbitrator
or panelist in numerous large complex arbitrations. Handled numerous disputes
regarding differing site conditions, joint venture partners, changes, design
defects, surety bond issues, public construction issues, and public procurement
issues. These disputes arose in buildings, power and industrial plants, dams,
bridges, roads, military facilities, transit systems, and airport and port
facilities. Mediated many disputes, including several multi-million dollar
public sector disputes. Mediator for the Center for Public Resources in New
York, the Massachusetts Superior Court, and the Superior Court Construction
Mediation Panel. Represented parties in mediation, in med-arb
proceedings, and in mini-trials.
